Louisiana's August Regulatory Docket: Five Fights Being Decided Before Anyone Files a Bill

Five Louisiana regulatory actions this August, from an $18 billion data center buildout to a reversed foster care reimbursement cut, share one trait: each is being decided before any 2027 bill exists.

Data centers accelerate, and the PSC writes the rules on who pays

Amazon Web Services added a third Shreveport campus on Aug. 18, $6 billion on top of the $12 billion it had already committed to two facilities in Bossier and Caddo parishes, bringing its northwest Louisiana total to $18 billion and roughly 750 permanent jobs. The dollar figure is public. The rate design is not, yet: Docket R-37905 and Docket X-37921 at the Louisiana Public Service Commission are writing the cost-allocation and interconnection rules for large loads right now, ahead of the Commission's Sept. 16 Business & Executive Session. On Aug. 12, the Commission voted 3-1 to let Meta keep its Richland Parish data center records confidential, overruling an administrative law judge who had found the subpoenaed information relevant to the Commission's own review.

An illegal-dumping task force opens a window for the 2027 session

The Task Force on Illegal Dumping Prevention and Enforcement, created by HCR 85 (Rep. Alonzo Knox), held its first meeting Aug. 21 at the Capitol. LDEQ's Kevin Scott told members that complaints rose 78.2 percent from FY2024-25 to FY2025-26, 458 complaints, with 768 projected for the current fiscal year, and that prosecution is inconsistent because some district attorneys rarely pursue referred cases. Keep Louisiana Beautiful's Susan Russell proposed tying commercial and business licenses to dumping enforcement, a remedy that does not exist in current law. The task force meets again in October, November, December, and January, wraps up by Feb. 12, 2027, and will report its recommendations to House and Senate committees.

Landry's critical-minerals orders put a 90-day clock on LDEQ

Gov. Jeff Landry signed two executive orders on Aug. 12, an Expedited Environmental Permitting order and JML 26-079, Securing Louisiana's Critical Minerals Supply Chain, directing LDEQ and other agencies to report within 90 days (roughly Nov. 10) on which permit categories can be permanently expedited. The policy targets a live buildout: ElementUSA's $850 million Gramercy facility to refine bauxite residue into gallium, scandium, iron, and titanium, and Syrah's $586 million expansion of its Vidalia graphite plant. The Gramercy refinery was cited for 23 environmental violations in June 2025 after a red mud spill into the Blind River Swamp watershed.

DCFS reverses a foster care reimbursement cut after one Senate hearing

DCFS raised foster care board rates from $600 to $900 per month effective July 1 but simultaneously stopped reimbursing incidental expenses, school supplies, uniforms, car seats, camps, which foster parents told lawmakers amounted to a consolidation rather than a raise. Franklin Parish foster parent Danielle Eley testified to that effect before the Senate Select Committee on Women and Children on Aug. 21. Sen. Patrick McMath pressed DCFS Secretary Rebecca Harris to delay the change for the current fiscal year, and Harris agreed on the spot to restore the reimbursements through June 30, 2027.

Medicaid reimbursement realignment converges with federal cuts and 2027 work requirements

Act 859 (Rep. Joe Stagni) raises Medicaid reimbursement for independently owned rural clinics by $41.50 this fiscal year and again next year, a shift rural hospital owners say advantages independent clinics over hospital-owned ones. One Avoyelles Parish operator was reimbursed $109 to $125 per Medicaid visit in 2025, financial stress he cited in selling to a private-equity-backed operator. Louisiana's Medicaid rolls have fallen by roughly 200,000 people over the past year under the Landry administration, and H.R. 1 is expected to bring further reductions over the next two years, hardest on rural hospitals. Separately, LDH is implementing federally mandated Medicaid work requirements, 80 hours per month for many adults 19 to 64, effective Jan. 1, 2027, while distributing its $208 million Rural Health Transformation Program award. The House Ways and Means Committee takes up LDH's third-party convenience fee schedules Aug. 27 at 9 a.m. in Room 6.

The bigger picture

None of these five stories required a legislative session to move, because in Louisiana the session is where policy gets ratified, not where it gets made. A task force minutes at the Capitol, a Public Service Commission docket, an agency secretary's commitment under committee questioning: this is where the terms get set, and an organization absent from that room receives the policy rather than negotiating it. The through-line from data centers to foster care is the same for any client sector, energy, healthcare, minerals, or association work: the comment period is the last stop, not the first one, and the fights worth winning are usually over before most people are watching.
